Notices under the Land Registration Rules 2003

When dealing with applications by means other than post, DX or personal delivery, the Chief Land Registrar may give notice publicising this.

Details

Under the Land Registration Rules 2003, rule 54C and Schedule 2, the Chief Land Registrar may, if satisfied that adequate arrangements have been made or will be in place for dealing with (i) documents in electronic form that purport to effect particular dispositions or (ii) applications and other matters by means other than post, DX or personal delivery, give notice publicising the arrangements.

The Chief Land Registrar has given notice of the arrangements in the attached Notices.

  1. Notice 19 has been amended to reflect the services currently available through Business Gateway.

  2. Notice 19 has been amended to provide transparency and clarification on how HM Land Registry receives, accepts and rejects applications lodged through Business Gateway.

  3. Suspension of certain notices as a result of essential maintenance work on all HM Land Registry electronic services from 16:00 hours on Friday 25 August 2023 until 06:30 hours on Tuesday 29 August 2023.

  4. Notice 2 has been amended as a result of an increase to the scope of the Qualified Electronic Signature Pilot to include a legal charge that is a remortgage of a registered estate, is a first charge and the chargor is the registered proprietor of the registered estate when the legal charge is created.

  5. Notice 25 has been amended as we can now accept applications to register a transfer by operation of law and a release from a charge (DS3) through our Digital Registration Service.

  6. Notice 17 has been amended as a result of an enhancement to Business Gateway to allow applicants to apply for an official search using a new schema which will provide a PDF certificate as normal but also receive information contained in the certificate as data which can be utilised in case management systems.

  7. Notice 28 has been amended to remove the specific reference to an application form relating to no more than one application, as HM Land Registry can accept a single form relating to multiple names where they are all names of corporations aggregate.

  8. Notice 25 has been amended as a lease is now a permitted application using the Digital Registration Service.

  9. Notice 6 has been amended to reflect revised arrangements for customer attendance at HM Land Registry offices and to include documents which are not kept in an electronic format in certain situations.

  10. Notice 25 has been amended as we can now accept applications to register transfers and assents of part and for the removal of Form A restrictions through our Digital Registration Service.

  11. Notice 28 added which allows applications by email for a search in the index of proprietors’ names.

  12. Notice 12 has been withdrawn as a result of the closure of HM Land Registry’s Find a Property service.

  13. Notice 19 has been amended. A new API (Registered Proprietor Name) has been added to Business Gateway to give customers the same name checking ability as already available via DRS through Portal.

  14. Notice 2 has been amended to increase the number of transactions where a qualified electronic signature can be used and so enable more to be learnt from the Pilot.

  15. Notice 27 has been amended. You can now inspect title plans and caution plans through HM Land Registry's Search for land and property service.

  16. Notice 25 has been amended as we now accept applications through our Digital Registration service where one or more parties is acting by an attorney.

  17. Notice 17 has been amended. The ability for business gateway users to request information regarding the Official Copies documents available to order. For any documents referred to in a title register, the service will provide users with details of the documents that HM Land Registry holds copies of, as well as an indication of whether that document will be available for immediate download or may require manual investigation. The service will also provide information about availability for immediate download of that title’s register and plan, as well as indicate if the title is currently subject to a pending application.

  18. Notice 27 added which gives details about applications for inspection of individual registers and individual caution registers through HM Land Registry’s Search for land and property information service.

  19. Notice 2 (under rule 54C) has been added and deals with documents in electronic form purporting to effect registrable dispositions.

  20. Notice 25 has been amended as HM Land Registry's Digital Registration service can now accept multi-title applications.

  21. Notice 25 has been amended to reflect that from 18 May 2021 it will be possible to lodge an assent application using the Digital Registration Service.

  22. Notice 25 has been amended to reflect that from 26 April 2021 the Digital Registration Service is changing from a private beta to a public beta.

Suspension of notices 7, 12, 13, 15, 16, 17, 18, 19, 20 and 25 given under Schedule 2 of the Land Registration Rules 2003 and notice 1 under rule 54C of the Land Registration Rules 2003.

  24. Notice 21 has been amended to confirm that both electronic addresses provided for the Swansea Office may be used. Notice 22 has been amended to update electronic addresses and change the methods of delivery of applications and their results.

  30. Amended notice 16 and new notice 17 added as a result of an upgrade in services in Business Gateway. New Direction 7 added as a result of new Pre-submission Enquiry Service and Application Management Service.

  31. Notice 16 has been revised. A new service is being introduced in HM Land Registry’s Business Gateway, to give users more day list information, similar to that provided by the existing Application Enquiry service available through the Portal. The new service will exist alongside the existing Business Gateway Day List service, to give users the time to adopt the new schema.

  32. Notice 25 has been amended as a result of enhanced functionality on the digital application form.

  33. New Notice 25 (Electronic Document Registration Service through Portal – eAP1 applications) has been published in relation to a trial we are running. A minor consequential amendment has been made to notice 20 also.

  34. Notices 21 and 22 and directions 1 and 4 have been amended as a result of a change of office name from Wales to Swansea.

  37. Amendments have been made to take account of changes to the e-CON service, and to confirm that the e-UN1 service can now be used for notices affecting part of a title.

  38. Notice 6 amended to clarify that copies of part are not available. Notice 16 amended as historical copies can now be ordered through portal. Notices 19 and 20 amended by the addition of references to Land Transaction Tax certificates. Notice 23 amended as a result of a change of email address.

  39. Suspension of notices 7, 12, 13, 15, 16, 18, 19, 20 and 21 of Schedule 2 to the Land Registration Rules 2003 and notice 1 under rule 54C of the Land Registration Rules 2003.

  40. A new Notice 1 under rules 54C of the Land Registration Rules 2003 has been added and amended notices and directions as a result of the Land Registration (Amendment) Rules 2018 coming into force on 6 April 2018.

  41. As a result of new HM Land Registry digital services being introduced on 12 February, we have added new notices 'Notice 17 - Applications to register digital mortgages' and 'Notice 24 - Large scale voluntary applications for first registrations'. We have also amended the 'Direction on large scale voluntary applications for first registrations'.

  42. We have added a variation to Notice 6 giving our opening hours over Christmas 2017.

  43. Notices 19 and 20 have been amended to more accurately reflect service improvements. Notice 23 has been amended to reflect that all emailed HC1 applications are dealt with by HM Land Registry's Durham Office.

  44. We have added a new direction that deals with Large Scale Voluntary Applications for First Registration. We have amended the direction that relates to documents being delivered with first registration applications.

  45. Notice 16 has been revised as withdrawals of searches can now be made through Land Registry's portal.

  46. New Direction added and an existing Direction amended to allow conveyancers to lodge certified copy deeds and documents on certain first registration applications.

  47. Notice 20 has been amended as a result of the introduction of the 'Reply to Requisition' service in portal that went live on Monday 7 November 2016.

  48. Withdrawal of notice 17 - Land Registry Network Services - applications to register electronic legal charges added.

  49. New direction added that gives details of the new proper office addresses from 30 August 2016.

  50. Notice of a suspension of electronic services on 18 and 19 June 2016 has been removed as that suspension is no longer happening.

  51. Variation of notices 7, 13, 15, 16, 18, 19 and 20 between 10am and 12 noon on Sunday 29 May.

  52. A suspension of notices 7, 12, 13, 15, 16, 17, 18, 19 and 20 has been added as a result of a suspension of electronic services from 8:55am on Saturday 18 June 2016 until midnight on Monday 20 June.

  53. New direction added that gives details of the new proper office addresses from 27 May 2016.

  54. A variation to notices 7, 12, 13, 15, 16, 17, 18, 19 and 20 has been added as a result of a suspension of electronic services from 1830 hours on Friday 4 March 2016 to 0600 Monday 7 March 2016.

  55. Notices 21, 22 and 23 and the direction that relates to electronic addresses for the delivery of objections have been amended as a result of a change to our email addresses.

  56. Notice 16 has been amended to reflect that where a plan in electronic form accompanies an application it can now be up to 10MB. Variations of Notices 6 and 22 have been added to cover opening hours over Christmas 2015.

  57. New Notice 23 and amended Notices 16 and 21 and Direction relating to the electronic delivery of objections. Also Notice 2 has been withdrawn.
